I received a 1099-R in July. I never rolled it over. I put money down on a first home in December. (More than the 1099-R). Is there a time limit that That I need to use the money for a home? Does a preconstruction payment count even though settlement won't be until July of 2001?

If anyone can point me in the right direction I would appreciate it. I am just trying to get out of paying the 10% penalty.
