I have been reviewing your sworn declaration.

What is startling to be is what you have omitted.

Unlike certain other director defendants, I noticed that you wrote no sworn statements about any accounting issues relating to Overstock.com.

Are you trying to avoid a perjury charge?

It seems that way since your affidavit shows the last date of your employment at Overstock.com as 01/02/08 contrary to your resignation letter and Overstock.com's 8-K disclosure which claims at you resigned on 12/31/07.

Since Overstock.com's disclosures and your comments at earnings calls are a central issue in the litigation and are being investigated by the SEC, will you exercise your right again self incrimination when called to testify on accounting issues and related disclosures.
