Court appointed guardianship should be avoided strenuously!!! And it's so easy to avoid with a durable power of attorney, a health care proxy, a Living Will, and, if advisable, a trust. Seeking court appointed guardianship is costly. It's often adversarial, since the person seeking guardianship may not be the agent the incapacitated individual might have chosen. Besides that, once you become a guardian, you are responsible to the court, and must report your every decision to that court, which may or not agree with your choices.
