I took a look at the 20 part test and it definitely looks like I'm an employee
My daughter ran into this a few years back. I forget exactly what we did but I believe she filled out some form for the IRS and got a determination from the IRS of "employee" as opposed to "independent contractor" status.
That might be important. Instead of assuming employee status and worrying about tax consequences in the event they don't agree, you should be able to get the IRS O.K. ahead of time.
I'm sorry I don't have time to investigate this further. Can anyone else out there help?
