Good article. I worked throguh my own distaste for the act, starting two scrolly posts that I abandoned as sorta beside the point before posting. At the moment I'm inclined to agree that indefinite detention under due processes rendered by the executive rather than the judiciary makes sense.

The danger of giving the executive power without judicial oversight is, well, an oppressive executive. But this is always the danger of having an effective executive, and it would be a foolish philosophy indeed that did not place safety from attack by foreigners high on our list of values.

It does require a bunch of faith in the executive to accept this. It is a feature, and not a bug, that people are constantly chipping away at this kind of raw executive power. It is dangerous for our enemies and it is dangerous for us.
