The problem is that the AG generally will garnish the entire amount if there is any back child support owed. We're in TX. Our AG's office will garnish first and ask questions later.
Then MFS is probably the winner. Remind them that TX is a community property state, so there are special rules. See Pub 555.
BTW, why in the world are they due a refund worth worrying about? Someone needs to give them Phil's stern lecture about the foolishness of giving the government an interest-free loan, even if you get the money back in the end. Time to get busy adjusting those W-4's.
