How does that work? Is it that if both can claim it that way, then they have to decide who gets to claim him on the tax return? And what if they both refuse to come to an agreement and it is not in the divorce decree?

If they both claim the child, then I would think it'll get flagged for an audit when the returns are processed.
And if the ex-spouses don't resolve it themselves, it'll get resolved for them by the IRS/court. (costing them probably a lot more in lawyers, etc.)
