It is when the tone or the actions are exploitative that it becomes offensive.

Certainly makes sense. Though very subjective. I seem to recall several years ago now (maybe 10??) that there was a huge uproar over a photo exhibit because there were some nude children in it. Some called it child porn. Others said it was art (and it was being displayed at a gallery or museum).

Is the law basically "I know it when I see it"?
