Yep - I and the Insurance agency for which I work got hit with a Professional Liability/E&O claim/lawsuit - I was named for not notifying the client that he needed to renew his direct-billed Work Comp policy. This was the first E&O suit I have been named in. I presented an audit, signed by the plaintiff, after the policy expired, and a couple of mounts before a worker suffered "heat stroke" on the first day of his work. The judge in the case dismissed the case, with Prejudice, but I still have a mark against me - Even thought vindicated, our E&O insurer has imposed a $7500 Deductible, with a $7500 annual premium - We insure a decent number or policy holders. I do my job.
