As I've pointed out, an SOL doesn't prevent a suit - it's only an affirmative defense to one. But you have to assert it in your Answer (or without a state-specified time-frame) to the suit.

There is a very good chance that a court will still accept a civil complaint even if the claim is outside the SOL.
