As I've pointed out, an SOL doesn't prevent a suit - it's only an affirmative defense to one. But you have to assert it in your Answer (or without a state-specified time-frame) to the suit.

Not completely true.

There are regulations that prevent collection agencies from even threatening to sue for time barred debts. Collection agencies are not known for being honest. It doesn't mean that they won't submit "incorrect" paperwork to a court claiming that the debt has been reaffirmed or threaten to sue when they have no legal standing to sue. If a suit is filed, it must be handled.
