A Federal Appeals Court, with the unanimous vote of three Republican appointed judges upheld lower court ruling that blocks Trump from withholding funds to sanctuary cities. The argument being that the underlying funding acts stipulate no such penalty or condition. They are saying only Congress can do this.

I presume Congress, as they did in the Fugitive Slave Act of 1850,could create any penalty they want for states not complying or assisting in enforcing Federal Laws. But Congress would need to stipulate the penalties.
