From what I've read by following the story, the legislation has gone through the House and the Senate, but has to be passed by the President, which more than likely be shot down (just like the marriage tax reform bill was).

Maybe a more knowledgeable Fool who's in the know can provide more to the story, but I believe Sen. Roth is behind this one as well as the original bill.
