Huh? Breach of fiduciary duty? Can you show a link where it states such?

I don't think Res meant that it *is* legally, but that it really should be. There's really no good reason to be paying loads for any kind of a group plan, when you can set up a similar plan with Fidelity, Vanguard, or several others and pay none at all. In almost all cases it'd probably be cheaper for the employees to pay the minimal fees rather than pay the loads - not to mention the typically higher expense ratios. Or heck, just knock $50 off the salary of everyone you higher and then it will pay for itself, and I don't think people will accept/decline a job based on $50, especially when its probably $30 or less after federal, state, FICA, & MEDI taxes.
