I would simply call, let them know what happened, let them know that they have a driver who is falsifying his times, and ask for a refund of the amount you paid for guaranteed delivery. That seems reasonable and proportional given the circumstances. The receipt should be read before assuming a refund is due. UPS next business day time-definite delivery is "typically delivered by". I don't see that they guarantee a refund if it isn't delivered by the time specified.
