Individuals should have a right to smoke. Companies should have a right to mandate that during working hours they don't. I have had a few jobs where there were smokers and non-smokers in the same place. The smokers generally took more sick days and had more breaks, both of which meant that the non-smokers were asked to fill in for the smokers. It was annoying to see people take 10 minutes or more every hour feeding their habit. Should I be allowed every hour to quaff another beer on the job, or run down to the corner to grab another slice of pizza?

My personal view is that during working hours employees are the mercenaries of the employer. You do what they tell you. If you think that their demands are too onerous, go find another job.
