It is my understanding that attorneys often try to get the defendents and/or the insurance company, depending on the suit, to issue two checks, one to the plaintiff, one to the attorneys. The settlement agreement must, as HatchetJack mentions, be carefully written. I tried to get hold of some attorneys that do this type of settlement work to find out the latest on how they do it. I'll post their response when I receive it.
