It's simply a difficult call to make...and depends upon how agressive you want to be with your tax return. But I wouldn't move forward on this without reading additional information in the various IRS publications and/or other tax books and/or various court cases and the like. can take the question to a qualified professional.

The expenses are certainly not currently deductible as an expense. Your only hope would be an addition to the basis of your property. And, it's possible that you can argue the issue either an addition to the basis or as completely non-deductible expenses. There is no clear cut answer on this issue IMHO.
