Actually, they own a patent on a couple of specific mechanics to the Magic game (i.e., turning the card to show it's been used), not to the collectible concept.

What happens to them if HAS decides it's better for them to distribute their products via Wal-Mart and Toys-R-Us?

I've already seen Magic (Portal) and Pokemon at Target and Walmart, at a serious discount to the game shop prices. Actually, with the Pokemon, I've seen the places where they can't keep it stocked... ;-). ...but I agree this can't make the shop owners happy.
