The recent article on not using a 401k, but going to other options including taxable investment accounts, misses discussion of other issues. It is my understanding that some of the IRA and 401k accounts are protected is cases of lawsuits. This can be an important issue with professional who have such risk. I would like to see some discussion / consideration of this issue in the analysis.

Your right. 401Ks are somewhar protected by ERISA. See
