My TIC experience has reinforced something my Father preached: small print usually only matters when you have no time to read it, and your reading glasses are the wrong prescription. 1031 TIC's were overwhelmingly marketed to near retirement age people who had only 45 days to select an investment. The TIC's were similarly created by many companies in a mad rush to scoop up the easy capital TIC's represented. The result is that many TIC contracts are full of extremely important, often sloppy, and frequently ignored language.

If you are in trouble, go through the contract with a fine-tooth comb. Pick every nit, and nail down every obscurity. In my TIC our struggles with our sponsor have been greatly assisted by knowing the fine print better than those who slapped it together.
