Does anyone know if state revenue agencies, specifically ILLINOIS, can withhold a portion of your federal refund for payment of past due state taxes?
Getting nasty threatening letters from IL........just curious.
Thanks

I don't know about IL personally but you could go to their web site and see what information you can find there. I do know that it does happen in some states. (How about paying IL off so you don't have a problem?)

Such offsets are allowed by IRC 6402(e), but only if the Federal return bears an address in the state requesting the offset. If you want to look at the statute, this link may work:

http://law2.house.gov/uscode-cgi/fastweb.exe?getdoc+uscview+t26t28+2026+1++%28%29%20%20AND

if it doesn't, you can search title 26, section 6402 at http://uscode.house.gov/usc.htm
