This, I think, is a terrible mistake. I don't know how the USSC can countenance two entirely separate systems I'd justice within the same country, based in a presupposition of the motivations of a crime which hasn't even been adjudicated yet.

I agree. The reality for terrorist cases though, is there is one legal system, with the presumption of guilt, for Muslims, and another one, with the presumption of innocence, for non-Mulsims.

In the cases of the Tucson and Colorado theater shooters, I do not recall there being any question whether they would have legal counsel and a public trial in a civilian court.

When Abdulmutallab (the underwear bomber) was arrested here in Detroit, the media was screaming that it was "wrong to let him get lawyered up".

Abdulmutallab initially cooperated with investigators, then stopped talking. The decision to read him his Miranda rights, advising him of his right to remain silent, generated criticism...[136] After the FBI brought two of Abdulmutallab's relatives from Nigeria to the U.S. to speak with him, he once again began to cooperate

So now, Tsarnaev, a naturalized US citizen, is being denied counsel, and there are demands to ship him off to Gitmo for a secret military tribunal.
