This surprised both of us as we thought she could not be penalized so long as her company insurance exceeded what she could get through Medicare. She'll get on Part B before the 8 month deadline but had she not talked to SS now she would have missed it by several months.

I don't understand this ruling but I point it out as a caution to others who may be in the same situation.

That's always been the case. Once you turn age 65, you become eligible for Medicare. The only way to avoid the premium penalty is if either you or your spouse is working and is covered by medical insurance through that work. If you turn 65 and still have coverage under a group insurance program from an employer or spouse's employer, you can delay enrolling in Medicare without penalty. Individuals over age 65 have until eight months after group insurance terminates to enroll in Medicare. Enrollment without penalty can be at any time between reaching age 65 and eight months after leaving a group plan.
