Unfortunately the problem is the silly thing called "Rule of Law.

There's also a thing known as fiduciary responsibility and many States make the abrogation of that fiduciary responsibility a criminal act. Does a banker have a fiduciary responsibility to invest the depositor's assets in a prudent manner? Or are they free to put it all on red 32?
