Thanks for the info. Here's what happened. We negotiated a settlement for the physical damages, not punitive. The defendants lawyer sent my lawyer the check. The reason being, my lawyer was to pay certain medical bills. I was responsible for the rest. He had better leverage with some of the creditors such a MRI facilities and some hospitals, I had better leverage with my personal doctors.

The 1099 Misc. was in box 3. Should he have sent me a different 1099? Or should I just attach a note to the return explaining it. Is there no place on the return where I can indicate that the 1099 is not taxable??
