If his hours are being scheduled by a Manager, then what you've described does not appear to be legal. The Owner (and Manager) are avoiding a lot of extra expense, paperwork and liability by mis-classifying your son.

It would make sense to talk with the Owner (or Manager) about this. They may eventually have to talk with the authorities as well.
