As it mentions in your link, the cable lines are the private property of the cable company. I'm sure any decision to open access would be met with lawsuits. Not just from AT&T, but from all the cable companies across america. Private property activists around the country might even get involved.

Even if these lawsuits result in access being opened, it will be years before this happens. By that time, ATHM will be the AT&T of cable internet, in my opinion.
