I don’t worry one iota about BRK’s exposure in that circumstance. I do however worry about what JeanDavid said - that we are at the mercy of the legislatures. I share his skepticism. Although at least two state Bills that I know of have been tossed that doesn't mean it’s over. They’re not desperate just yet.


I also wouldn’t be surprised if legislators ignored the constitution and wrote in retroactive coverage. However, all constititional democracies have mechanisms to insure that when this happens, an aggrieved party can appeal to another branch of government - the judicial branch. I am not a lawyer, but I don’t think there is really much chance that a retroactively imposed coverage would hold up to the inevitable court challenges.
