In my non-legal opinion, if he was an employee part-time or not shouldn't matter. Hopefully he has copies of his time sheet/card to prove his hours.

OTOH, if he was a contractor/consultant for them then now he's just another creditor awaiting payment.

Just curious: If he was doing a few hours a week for a few months how come he wasn't paid on a more regular schedule during those months? Even part-time employees normally receive a paycheck on the same pay days as full-timers.
