It might. Musk may prefer to keep retail investors in the company, but it's not entirely up to him. The SEC and whatever entities are providing the funding for the EBO also have a say in it. Musk might not be afraid of complicated, but the SEC might not permit a private company to have small, retail investors participating through an outside vehicle - and whatever funding sources are taking the company private might not want to deal either with those complications or the SEC on the matter.

The lawyers and ex-SEC hands discussing this issue on Twitter agree to a person that Musk cannot pull off an LBO while taking all all the starry eyed cultists with him til the bottom drops out. Well, it wasn't put in those words, but, the safeguards are there to protect the un-savvy investor who don't read balance sheets and understand the wealthiest investors are always looked after first through connivance (a word an ex-Morgan Stanley lawyer used.)

Just today another lawsuit was filed by a former cultist who took out a $200,000 loan to buy TSLA long on the day of Musk's 420 Pump. I know this young man in his late 20s because he said I and several other shorts who could only find puts and calls on that day (I shorted calls and bought puts) would be wiped out in a week. That's the type investor who needs protection. And there are hundreds-of-thousands of these kids following Musk.

(Amazingly, some of these Millennials have taken to calling out Elon on Twitter for having allowed Big Oil in the form of the House of Saud to take a position in Tesla. One young man sold his Tesla in protest.)

It's as if the Millennials believe that by being born at the turn of this Millenniium they were touched by the hand of some sci-fi Good Force as "special" people who will take us into the future. Musk is their Superior Being to show us slow thinkers how its all done.

I'm a Boomer. My business associate is a Generation Xer. We both have disdain for how our generations have screwed this planet and the United States of America as a leading light. The Millennials bother me. Easily distracted. But their younger brothers and sisters? Now those kids are where I put my money in turning around the easily distracted.

Pick your friends wisely. So many have sold out to stay in their comfort zone of deniability.
