Judge OVERTURNS California's 32 year ban on assault rifles after ruling it violates Second Amendment right to bear arms

District Judge Roger Benitez handed down the ruling in San Diego on Thursday

Said Golden State's 1989 ban on assault rifles was 'unconstitutional'

Case was brought against California AG by three men and San Diego gun club

Pending case is also seeking to have minimum age to buy a gun lowered

Currently, no-one under the age of 21 can buy a gun in California

Plaintiffs say that's discriminatory, and want minimum age lowered to 18

California´s attorney general Rob Bonta argued that assault weapons as defined by the law are more dangerous than other firearms and are disproportionately used in crimes and mass shootings. ...
From the comments

“ Federal Bureau of Investigation murder statistics do not track assault rifles, but they do show that killing by knife attack is far more common than murder by any kind of rifle. In California, murder by knife occurs seven times more often than murder by rifle. For example, according to F.B.I. statistics for 2019, California saw 252 people murdered with a knife, while 34 people were killed with some type of rifle not necessarily an AR-15. A Californian is three times more likely to be murdered by an attackers bare hands, fists, or feet, than by his rifle. In 2018, the statistics were even more lopsided as California saw only 24 murders by some type of rifle. The same pattern can be observed across the nation.”

If I were a judge I would not be happy with the State presenting outright lies as arguments. But this kind of distorted emotion based "thinking" is so typical of Lefties

"In addition to issuing a permanent injunction Friday, Benitez granted a request from California Attorney General Rob Bonta (D) for a 30-day stay of the ruling, which will bring about an appeal from the state."

Get ready SCOTUS, her it comes.

But the judge's comparison of the rifle to a Swiss Army Knife was kind of wacky. The knife doesn't fire bullets.

"The news out of California reverberated across the nation over the weekend. Fred Guttenberg, whose 14-year-old daughter Jaime was killed in the 2018 mass shooting in Parkland, Fla., denounced the judge for using “the exact language of the gun lobby” in his ruling. A version of the AR-15 was used to kill 17 people at Marjory Stoneman Douglas High School.

“My daughter’s in a cemetery … because a Swiss Army knife was not used. Because it was an AR-15,” Guttenberg, a gun safety activist, told CNN. “If a Swiss Army knife was used, my daughter and most of those other kids and adults would be alive today.”

The judge was comparing to the Swiss army knife in the sense of the rifles versatility, and not its lethality or ability to fire a bullet.

Thinking people with basic reading comprehension skills can see this. This explains why CNN and the people who watch it don't grasp what the judge was saying.

and the Swiss Army knife (as the name suggests was developed for the Swiss Army) but then found so useful and versatile that it came into wide use by civilians. And guess what, it's military origin does not make it evil.Non shooters may not known that the A15 type of rifle is modular, multiple variations are possible without any special skills. It is nearly unique in that regard. Also nearly unique in being as accurate a most bolt actions.

The AR-15 platform is the highest selling rifle type in the US. Thus by definition it is in common use. And as everybody but Lefties know, the civilian version is not fully automatic and thus differs substantially from the military version, and thereby also by definition is not a military assault weapon. All of which are fully automatic. The semi automatic version of the MI carbine (around since the 1940's) has never stirred up such idiotic hatred but is functionally the same as the civilian AR 15, It just does not look "evil"

The facts can not be argued. Civilian AR 15 are in wide use. While a disproportionate number of mass terrorist murders (only if you do not count 9/11 and Oklahoma type events) are committed with ar 15 and AK type weapons, the total people killed with AR 15 rifle is minuscule compared to other shootings.
And for those Lefties who think guns are needed for mass murder see Rwanda where it was done by machete https://www.bbc.com/news/world-africa-26875506 800,000 people.

In the department of bogus statistics is this one
". In 2017, 46% of all murders were committed with handguns, federal data show." True. But only because in many (most?) cases local police reports to FBI did not specify what kind of weapon was used in the murder.
