Manchin and Sinema have already voted in favor of several of the federal judges that are on Biden's list, Biden should stick with confirmed lower court judges that are qualified.

Hawkwin: Based on what legal expertise - especially when compared to others that have decades of bench experience?

Amy Coney Barrett had less than 3 years of bench experience. And historically, several justices had zero judicial experience, including, most recently, Elena Kagan and William Rehnquist.

But Biden is never going to nominate either Obama for this vacancy and, not that it matters to anyone, but I wouldn't be in favor, nor, most likely, would most other libruls.

After the defeat of his nomination of Clement Haynsworth to the Supreme Court, Richard Nixon nominated Harold Carswell, then a judge of the Fifth Circuit. Carswell was known for opinions that seemed to delay desegregation, which was probably the reason for the nomination (i.e., to further endear Nixon to Southern reactionaries), but that wasn't what doomed the nomination.

Carswell had a reputation for being an intellectual lightweight bordering on incompetence. In perhaps the greatest own-goal backfire, Republican Senator Hruska of Nebraska had this to say in support: “Even if he were mediocre, there are a lot of mediocre judges and people and lawyers. They are entitled to a little representation, aren’t they, and a little chance? We can’t have all Brandeises, Frankfurters and Cardozos.” With supporters like these . . .
