Our second question is whether anyone has successfully challenged the "Included in BK" designation. On the surface, the label implies that the loan wasn't paid - the only justification for the label is that we didn't reaffirm the debt. Yet, in most states in the US, under current law, it is perfectly legal to not reaffirm a debt, pay the required payment and keep the asset - in this case our Toyota.

Our last question is whether anyone has ever been able to purchase a leased vehicle (with 75% financing) 3 years post BK. We leased a car from Volvo before filing. The lease is up in a few months (3 yrs post discharge). We have never made a late payment on the lease and our credit is perfect post bk - we just bought a house and got conventional financing. What are the chances Volvo will approve us at a decent rate, assuming we can put 25% down on the purchase of a 4 yr old car (residual - $15K)
