This is not a legal problem. The US government has created the problem by socializing elder care. I think people in nursing homes should be evicted if they cannot pay the rent. I believe the state should be responsible for transfering them to somewhere cheaper perhaps in a different city, state, or even country. My guess is that as the aged population grows states will create the equivalent of 'poor houses' for them. This is not nice but I think it can be humane.

The problem is that nursing home owners and workers, wealthy individuals (and their children), elder law specialists, and bureacrates all benefit from this.
