the board is supposed to emulate actual conversation and the weight of these postings is about as heavy as cocktail hour conversations (remember those?). Definitely that swiss company is making a fool of themselves. someone obviously doesn't know how to not take themselves so seriously.

You said a lot in a few words. I agree with you that posting on a message board is about like having a cocktail hour conversation. Additionally, every forum I have seen on the Internet tells its customers to do their own research and that it's not responsible for the accuracy of other subscribers posts. None of the Elan 11's posts on Yahoo were "copyrighted, sent to the media for publication, or diseminated widely". Without this lawsuit, how many non-Elan investors ever visited that board? I'm sure it's quite busy now. So, will we now have to start worrying about attorneys, with legal pad and pencil in hand, showing up at our cocktail parties? Na, they have gone high-tech. However, some of them might just start recording our conversations using a hidden tape recorder. But thats another issue...our continuous loss of privacy. :)
