The lawsuit that I believe that you were referring to was not about operation of Cooper, but about the decommissioning costs that MEC has paid as part of their part ownership in the nuclear station.

The court ruled in NPPD's favor and essentially said that any decommissioning costs that MEC has paid will remain in the plant's decommissiong fund even if the plant is operated after MEC's contract with NPPD expires.
