The liberals win again.


If the Prop 8 lawsuit is thrown out on the basis of no standing to sue, that will not be a liberal or conservative win, but will show how both sides of the current bench understand that without strict appliance to procedure and clear understanding of when the courts may or may not be used, the whole thing becomes an even bigger mess.

This is a case where some people not beholden to the California electorate are attempting to impose their view on the state and its citizens.

I say: Good for the Court if it so rules.

Also, DOMA was always a prime example of how the right wing and conservatives are willing to overstep the limits on Federal reach to push their political agenda, despite their claims to the contrary. This, of course, has always been true -- people argue states rights when they don't like a general trend, whether or not they believe in states rights.

After all, Dred Scott imposed the rights of the southern states, who had slavery, on the rights of the northern states, who wanted nothing to do with it. Yet abusing that philosophy didn't bother the south at all.

And, please, don't respond by saying "libruls do it too." Of course they do -- there is a continuous debate on where the line is to be drawn between the rights of the states and the rights of the Federal Government, and it is not drawn in cement. Can't be.

By the way, think about Ben Franklin's statement there, and understand that he applied this philosophy to the South's demand to keep slavery.
