We didn't. Very soon the Supreme Court claimed that it was the supreme law of the land, and the judicial conspiracy to acquire more power has been the most enduring conspiracy against the constitution, stronger than ever after 200+ years.


While the Supreme Court CLAIMS to protect the interest of the weak and powerless, in practice it acts to extend the power of majorities, doing things politicians in Congress would never have the nerve to do.


The Constitution gives Congress the power to regulate the Supreme Court. Congress could pass regulations explicitly overriding selected Supreme Court decisions and barring the Court from considering certain arguments - and then impeach justices and remove them if those regulations are violated.

AFAIK this power has never been used.

On the other hand, it has been firmly established - with Supreme Court approval - that for purposes of impeachment, "high crimes and misdemeanors" means whatever Congress decides it means while considering the impeachment in question. They could impeach and remove a Supreme Court justice for wearing the wrong color shirt under the robes.
